Holiday Claims

Thousands of people go on holiday, either in this country or abroad, and return home with happy memories of an enjoyable and relaxing time. For a few, however, their memories will be of a less than happy experience because they suffered a holiday injury or holiday illness through the negligence or lack of care of others.

If you suffered an injury whilst on holiday in this country then your claim for compensation could be handled in the exactly the same way as any other personal injury claim would be. If however, your injury or illness occurred whilst on holiday abroad the rules for making a claim are different.

If your holiday was purchased as a package holiday and included flights and accommodation the Package Travel Regulations which were introduced in 1992 allow a claim to be made in the UK, even if the accident occurred while on holiday abroad.

Have you suffered injury or developed an illness on a foreign holiday?  If this was because of any fault on the part of the hotel staff or the holiday company then you may be able to bring a claim against the tour operator.

 On a package holiday, the tour operator arranges your transport and also your accommodation. Other ‘extras’ may also be provided as part of the package. If you have not been provided with a reasonable standard of care in respect of any aspect of that ‘package’ and if you have suffered injury as a result then you may have a claim.

    Examples may include:
    • Food poisoning caused by badly prepared food served in your hotel
    • Accidents caused by collapsing furniture, faulty shower fittings or defective flooring in your room
    • Accidents in the hotel bar or around the pool
    • Road traffic accidents as a result of careless driving of the coach driver on the transfer trip or on an activity organised by the tour operator

What constitutes a ‘package holiday’ is currently a matter of some dispute – particularly because a lot of us now book our holidays over the internet. Holiday companies will often attempt to deny liability by arguing that they are simply a ‘travel agent’ rather than a ‘tour operator’.
